Construction-Phase Protections

Construction must occur within clear limits for hours, dust, lighting, traffic, vibration, and generator noise.

Provisions

  1. Construction Hours — Strict Limits
    Work is limited to 7:00am–6:00pm Monday through Friday and 8:00am–4:00pm Saturday. No Sundays or federal holidays.

  2. Off-Hours Construction Penalties
    Unauthorized work triggers a $25,000 penalty per incident. A third violation within 30 days requires a 72-hour shutdown.

  3. Construction Dust & Air Quality
    Property-line monitoring, dust suppression, wheel-wash stations, covered stockpiles, and penalties for visible dust or excessive PM10.

  4. Construction Lighting
    Lighting must be shielded, directional, and aimed away from homes. Continuous overnight illumination is prohibited.

  5. Construction Traffic Management
    Approved haul routes, GPS tracking, daily truck limits, off-site worker parking, and traffic controls near school-bus routes.

  6. Vibration Monitoring & Structural Protection
    Nearby homes receive pre-construction structural surveys, real-time vibration monitoring, and protection against construction-related damage.

  7. Noise During Generator Testing
    Generator testing must follow operational noise limits and cannot occur overnight, on Sundays, or on federal holidays.

  8. Noise During Grid Outages
    Noise limits remain enforceable during outages, and extended generator use increases community-impact payments.
