Provisions

Survival of Obligations
All Charter obligations run with the land and remain binding on future owners, tenants, successors, and assigns. -
Developer Liability for Subcontractors
The developer remains responsible for the actions and violations of every contractor, subcontractor, vendor, supplier, and agent working on the site. -
No Arbitration; No Sovereign Immunity
Disputes must be heard in Burke County Superior Court. The developer waives any right to force private arbitration. -
Reservation of Police Power
The Town retains the authority to adopt additional regulations, ordinances, or emergency orders needed to protect public health and safety. -
Severability
If one provision is found invalid, the remainder stays in effect. Certain core protections are designated as essential and non-severable.
