Governance & Permanence

The Charter is intended to remain enforceable through ownership changes, contractors, disputes, and future regulations.

Provisions

  1. Survival of Obligations
    All Charter obligations run with the land and remain binding on future owners, tenants, successors, and assigns.

  2. Developer Liability for Subcontractors
    The developer remains responsible for the actions and violations of every contractor, subcontractor, vendor, supplier, and agent working on the site.

  3. No Arbitration; No Sovereign Immunity
    Disputes must be heard in Burke County Superior Court. The developer waives any right to force private arbitration.

  4. Reservation of Police Power
    The Town retains the authority to adopt additional regulations, ordinances, or emergency orders needed to protect public health and safety.

  5. Severability
    If one provision is found invalid, the remainder stays in effect. Certain core protections are designated as essential and non-severable.
