Prohibition of Foreign Ownership or Control
The facility and operating entity must be incorporated in the United States and majority-owned by U.S. citizens or qualifying U.S.-domiciled entities. -
Beneficial Ownership Disclosure
Every person holding at least a 5% ownership or control interest must be publicly identified, including citizenship, domicile, and percentage of ownership. -
Data Protection Certification
Encryption keys, credentials, and root-level administrative authority must remain under the control of U.S. persons located on U.S. soil. -
Supply Chain Integrity
Servers, networking equipment, and operational technology must come from manufacturers in the United States or allied nations, excluding restricted entities. -
Penalty for Violation
Violations trigger the Hard-Stop Shutdown, forfeiture of performance bonds, and mandatory decommissioning at the developer’s expense.
